Welcome to Lubrigard Ltd.
Customer shall pay Lubrigard in full within 30 days from date of invoice, F.O.B. shipping point. Customer shall pay the current list price for each Product unless otherwise agreed in a Purchase Agreement, subject to additions necessary to cover federal, provincial or other taxes or duties upon the Products or services herein described, all of which shall be paid by Customer. Prices are subject to increase with 30 days written notice. Once accepted, orders are not subject to cancellation without prior consent. A cancellation fee may apply.
Quotations and Pricing Errors
All quotations, proposals, price lists, order acknowledgements, invoices, website listings, and catalogue prices are provided for the Customer's convenience and are subject to verification and correction by Lubrigard. Unless otherwise stated in writing, quotations are valid for thirty (30) days from the date of issue and do not constitute a binding offer until accepted in writing by Lubrigard.
Lubrigard reserves the right, in its sole discretion, to correct, modify, withdraw, refuse, or cancel any quotation, order, order acknowledgement, or invoice that contains a typographical, clerical, computational, transcription, programming, configuration, currency, unit-of-measure, or system-generated error, or any other inadvertent inaccuracy (a "Pricing Error"), at any time — including after the quotation has been issued or the order has been acknowledged or accepted.
If a Pricing Error is identified, Lubrigard will notify the Customer in writing. The Customer may then elect, within five (5) business days of that notice, to either (a) proceed with the order at the corrected price, or (b) cancel the affected order or line items without penalty and receive a refund of any amounts paid in respect of the cancelled portion.
Lubrigard shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages, or for any lost profits, lost savings, or business interruption, arising from or in connection with a Pricing Error or its correction. Obvious or manifest errors — including, without limitation, prices significantly below Lubrigard's cost or prevailing market price — are not binding on Lubrigard regardless of whether an order has been acknowledged or partially fulfilled.
